Real Property:

This section discusses foreclosures on real property, including the procedure and forms necessary to foreclose on a Deed of Trust securing real property when a debtor is in default on a real estate lien note.

This includes forms to: advise the debtor of the lienholder's decision to accelerate the mortgage, the appropriate documents to appoint a substitute trustee and post the notice of substitute trustee sale, and associated documents necessary to complete the foreclosure process.
Also included is a form governing foreclosure on builder's and mechanic's liens used in connection with construction and subcontractor documents. This section does not discuss judicial foreclosures.
